Court Certifies Class of Bosa Condo Owners in Square Footage Litigation

On July 7, 2011, the San Diego Superior Court certified a class of “all persons
who purchased from Bosa residential
units developed by Bosa in California.”
The class includes purchasers in the
Bayside, Electra, Legend, Discovery,
Park Place, Horizons, The Grande,
Marquee and Radiance. The lawsuit
alleges Bosa and RE/MAX Real Estate
Development misrepresented the
square footage of the condominium
units in a “bait and switch” scheme,
resulting in units that are 7% to
28% smaller than advertised.

Welcome to the Enfamil LIPIL® Settlement

In order to receive settlement benefits, you must submit a claim form. You can fill out and submit the claim form online, or click here for a claim form you can print out and mail in.

A Federal District Court has approved the settlement of this class action lawsuit involving Enfamil LIPIL®. The lawsuit alleges that Mead Johnson & Co., LLC falsely represented that Enfamil LIPIL® is the only infant formula that contains DHA and ARA.

Under the settlement, Mead Johnson will create a fund of up to $12 million to provide cash or Enfamil Premium® Infant formula to Class Members who timely submit a valid claim form. You can fill out and submit a claim form online at www.FormulaSettlement.com.

If you are a Class Member, you can receive cash or infant formula at your option. You are a Class Member if you purchased Enfamil LIPIL® infant formula in the United States between October 13, 2005 and March 31, 2010. You are not a Class Member if you purchased the formula for resale or received the formula through the WIC program. 

If you purchased Enfamil LIPIL® for more than 6 months, you can choose between two 12.5 oz. containers of Premium® Infant Formula or $12. 

If you purchased Enfamil LIPIL® for 6 months or less, you can choose between one 12.5 oz. container of Premium® Infant Formula or $6.

To obtain the cash or forumla, you must mail or submit a completed claim form online by November 25, 2011.
